Conflicto de competencia entre el Juzgado Primero Penal Municipal con Funciones de Conocimiento de Bogotá y el Juzgado Segundo Promiscuo Municipal de Acacías (Meta).
La controversia se generó en torno a las diferentes interpretaciones que del factor territorial hicieron los despachos judiciales involucrados.
Teniendo en cuenta que ambos juzgados tienen la competencia para decidir la acción de tutela, considera la Corte que se debe respetar la elección que hizo el accionante y disponer que sea el juzgado de la ciudad de Bogotá quien de manera inmediata la tramite y adopte la decisión de fondo a que haya lugar.

- Primero. Penal Municipal con Funciones de Conocimiento de Bogota, dentro de la accion de tutela formulada por el senor Miguel Angel Penagos Nino en contra del Instituto de Transito y Transporte de Acacias (Meta).
- Segundo. REMITIR el expediente ICC- 3406 que contiene la accion de tutela presentada por el senor Miguel Angel Penagos Nino al Juzgado
- Primero. Penal Municipal con Funciones de Conocimiento de Bogota, para que, de manera inmediata, tramite y adopte la decision de fondo a que haya lugar.
- Tercero. Por la Secretaria General de la Corporacion, COMUNICAR a la parte accionante y al Juzgado
- Segundo. Promiscuo Municipal de Acacias (Meta) la decision adoptada en esta providencia.
